This Privacy notice ("Notice") provides Duna Swim Kft's customers ("Data Subjects") with information on the processing of their personal data („Data”) in accordance with the EU General Data Protection Regulation 2016/679 ("GDPR").

4.          Amendments to the privacy notice

The Data Controller may amend this Privacy Notice at any time, but shall inform the Data Subject accordingly.

5.            Data Subjects' rights in relation to data processing

  • Right of access

Data Subjects have the right to request information from the Data Controller, through the contact details provided in the Notice, as to whether or not their personal data are being processed and, if such processing is taking place, the right to be informed that

  • what personal data the Controller is processing; on what legal basis; for what purpose; for how long;
  • to whom, when, under what law, to which personal data the Data Controller has given access or to whom the Data Controller has transferred the personal data;
  • the source of their personal data;
  • whether the Data Controller uses automated decision-making and its logic, including

The Data Controller shall provide tot he Data Subjects’ a copy of their processed personal data free of charge for the first time upon the Data Subject's request, and may charge a reasonable fee based on administrative coststhereafter. In order to ensure data security and to protect the rights of the Data Subject, the Data Controller shall verify the identity of the Data Subject and of the person who wishes to exercise his or her right of access. The request of information, access to or copying of the Data shall be subject to the identification of the Data Subject.

5.2.         Right to rectification

The Data Subject may request the Controller to rectify any of his or her personal data through the contact details provided in this Notice. If the Data Subject can credibly demonstrate the accuracy of the rectified data, the Controller shall comply with the request within a maximum of one month during the period of processing and shall notify the Data Subject thereof using the contact details provided by the Data Subject.

5.3.         Right to restriction of processing

 

The Data Subject may request, through the contact details provided in this Notice, that the Data Controller restricts the processing of his or her personal data (by clearly indicating the restriction of processing and ensuring that it is kept separate from other data) where

  • the Data Subject disputes the accuracy of his or her personal data (in which case the Controller will limit the processing for the time necessary to verify the accuracy of the personal data);
  • the processing is unlawful and the Data Subject opposes the erasure of the Data and requests instead the restriction of their use;
  • the Data Controller no longer needs the personal data for the purposes of the processing but the Data Subject requires them for the establishment, exercise or defence of legal claims; or
  • the Data Subject has objected to the processing (in which case the restriction shall apply for a period of time until it is established whether the legitimate grounds of the Data Controller override the legitimate grounds of the Data Subject).

5.4.  The right to object

The Data Subject may object to the processing of his or her personal data if he or she considers that the Data Controller is processing his or her personal data inappropriately in relation to the purposes stated in this Notice bycontacting the Data Controller via the contact details provided in this Notice. In such a case, the Data Controller must demonstrate compelling legitimate grounds for processing the personal data which override the interests, rights and freedoms of the Data Subject or for the establishment, exercise or defence of legal claims.

5.5  Right to erasure

In relation to the processing described in this Notice, the Data Subject may exercise his or her right to erasure if the she or he has withdrawn his or her consent (in the case of processing based on consent) and there is no other legal basis for the processing or the purpose of the processing has ceased.

5.6  Right to data portability

The Data Subject may request to receive the personal data provided to the Data Controller in a structured, commonly used, machine-readable format, where the processing of personal data is based on consent and the processing is carried out by automated means.
